Who the contract is with

These terms are an agreement between you and BE VISIBLE MARKETING LLC, 30 N Gould St Ste R, Sheridan, Wyoming 82801, United States. In these terms, "we" and "us" mean that company, and "you" means the person or organisation using PebbleSEO. By using the service you accept these terms.

The service is currently a free pilot

PebbleSEO is in a free pilot. There is no charge to use it today and no card is taken to start. Pricing will be introduced later.

No charge will ever be applied without you agreeing to it first. If we introduce a paid plan, we will tell you what it costs and you will have to choose it. Nothing converts automatically.

Acceptable use

Use the service lawfully. Do not attempt to access another customer's workspace, probe or overload the infrastructure, resell access without our agreement, or use the service to build a competing dataset out of other people's data.

Do not upload data you have no right to. You must have the right to hold and process any Search Console, Bing, OtterlyAI or Semrush data you import, including where it belongs to a client.

Your data

You own your data. You grant us only the licence needed to store it, process it and display it back to you and the members of your workspaces, and to export it when you ask.

We do not use your data to train models. We do not aggregate it into a benchmark product. We do not sell it.

Availability

Stated honestly: there is no uptime guarantee during the pilot. We will keep the service running and fix what breaks, but we are not promising a service level, and maintenance may happen without notice.

Data permanence

Permanence is the promise of this product, so it matters what happens if you stop using it. If your account lapses or is closed, your archive is retained for a grace period of 90 days. During that period you can export everything, or reopen the account and carry on.

Only after that 90 day period does the data get deleted, and we will email you before anything is deleted. Data you delete yourself, by deleting a property or a workspace, is removed immediately and irreversibly.

Export and account deletion

Every table exports to CSV and every chart to PNG, at any time, without asking us. You can delete a property, a workspace or your whole account from inside the product. Deletion is irreversible and you will be told so, with the row count, before you confirm.

Limitation of liability

The service is provided as it is. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss of data beyond what we are directly responsible for. Where liability cannot be excluded, it is limited to the amount you have paid us in the previous 12 months, which during the pilot is zero.

Nothing in these terms limits liability for fraud or for anything else that cannot lawfully be limited.

Termination

You can stop using the service and delete your account at any time. We can suspend or close an account that breaches these terms, and we will tell you why. In either case the 90 day grace period above applies before your archive is deleted.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, and the courts of Wyoming have jurisdiction.

Changes to these terms

If we change these terms we will update the date at the top of this page. For a material change, including anything about pricing or data retention, we will email account holders before it takes effect. Questions go to hello@pebbleseo.com.
